Dr. Ateyah Sexual Assault Class Action —

This proposed class action against Dr. Wameed Ateyah is being brought on behalf of his patients who he sexually assaulted.

Case Overview

Waddell Phillips has joined forces with Howie, Sacks & Henry LLP to launch a proposed class action lawsuit on behalf of patients of Dr. Wameed Ateyah (Dr. Ateyah) who were sexually assaulted while under his medical care.

The Facts

Dr. Ateyah began his medical practice in 2004, and received his certification as a specialist in family medicine in 2005. Dr. Ateyah has been the subject of College of Physicians and Surgeons of Ontario (CPSO) disciplinary proceedings several times during his career.

In 2018, the CPSO’s Inquiries, Complaints and Reports Committee ordered him to complete a continuing education and remediation program related to the CPSO’s policy on Maintaining Appropriate Boundaries and Preventing Sexual Abuse. Dr. Ateyah’s certificate of registration was suspended briefly in 2020 and he is currently barred from practicing medicine until April 6, 2022.

In October 2020, local media outlets reported that Dr. Ateyah had been charged with 19 counts of sexual assault and one count of sexual exploitation by the York Regional Police. News coverage noted that one of the alleged victims was 17 years old at the time of the incident. Other public records indicate that the number of sexual assault charges against Dr. Ateyah has since risen to 26.

Police investigators have said that the alleged assaults that have been reported so far took place at the Schomberg Medical Centre at #17250 Highway 27 between 2008 and 2017. Dr. Ateyah left the Schomberg Medical Centre in 2018, but he may have also practiced at walk-in clinics and other facilities in King Township, Newmarket or elsewhere in southern Ontario.

The Proposed Class Proceeding

We are currently working with a client to commence a class action against Dr. Ateyah, on behalf of that patient, and any other patients who were assaulted by Dr. Ateyah while seeking medical treatment.
